Classification of people by the government is indeed a source of social injustice. It is also a widely used tool by the politicians. Nazi Germany, for instance, had mastered it and skillfully deployed it to its own advantage. This philosophy was captured in a former Nazi officers commentary,
" Naturally the common people don't want war: neither in Russia, nor in England, nor for that matter in Germany. That is understood. But, after all, it is the leaders of the country who determine the policy and it is always a simple matter to drag the people along, whether it is a democracy, or a fascist dictatorship, or a parliament, or a communist dictatorship. Voice or no voice, the people can always be brought to the bidding of the leaders. That is easy. All you have to do is tell them they are being attacked, and denounce the peacemakers for lack of patriotism and exposing the country to danger. It works the same in any country."
Needless to say, this same tactic or ruse has been employed again recently in the United States. Human tragedies are bound to take place in a society that fervently believes in and faithfully follows the dichotomy that either you are with us or you are with the terrorists. Injustice will be afoot even when there still exist distinctions between democracy and dictatorship. This echoes Lao-tzes lamentation over the loss of true beauty due to the artificial difference of beauty and ugliness.
In the United States, in the area of civil rights, the Supreme Court over the past few decades has developed a three-tier constitutional review mechanism to scrutinize federal and state laws that involve classification and labeling of citizens based on certain attributes. A law that affects the fundamental rights (e.g. marriage, procreation, and freedom of speech/religion, etc.) and involves a classification based on race and national origin, for example, will not be upheld unless the government can demonstrate that such classification is necessary to accomplish a compelling government. (the Strict or Maximal Scrutiny test) Similarly, government regulations based on gender and age classification will also have to pass the Medium and Minimal Scrutiny, respectively. While the Constitution provides some limited safeguards against government intrusion into the lives of American citizens, it provides very few restraints on the executive branch in the area of foreign affairs and international policies. Under the separations of powers, the Court is always silent on political issues. The President therefore has virtually unfettered discretion in issues that potentially affect the lives of millions of people around the world. This partially contributes to the rise of American hegemony in the past few decades. On the other hand, the extent to which Executive Branch has directly and indirectly exerted its influence on the Judicial Branch is far greater and graver than most people have realized. During the New Deal era, for example, in response to a series Supreme Court decisions (under the Commerce Clause of the Constitution) striking down bills enacted by the Congress and signed into law by FDR, the President threatened to pack the court with 16 justices and forced one Justice to switch side to vote in favor of the subsequent bills. Many Constitutional scholars later referred to his episode as a switch in time saves nine. Obviously, the President may also indirectly affect the Judicial Branch through his appointment power. As a result, judicial decisions based on partisanship, political orientation and even personal values, are not hard to find. The combined effects of the Constitutional design are that the President may subject, at his pleasure and discretion, the freedom of non-US citizens and independence of other sovereign countries to his arbitrary and willful intrusion. And he may simply do that by throwing out labels such as Terrorists, Axis of Evils and A Country with WMD.
It would be illusory to believe that Democracy automatically eliminates for all human evils. While a democratic society is clearly a step closer toward a better society, a system that stays stagnant, impervious to changes and unyielding to perfection is one what will fail someday. As the current events can attest, the human-degrading and people manipulating classification tool embraced by the Nazi Germany is also being wielded by Bush. We should all be aware of, and willing to explore, a better alternative to what we presently know as the best and perfect system.
